Terms of Service

Please read these terms carefully before using GigYard. By creating an account or making a booking, you confirm that you have read, understood, and agreed to be bound by these terms.
1. Agreement to Terms
By accessing or using GigYard (gigyard.com.au), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you may not use the platform. These terms apply to all users, venues, bands, and visitors.
GigYard is operated by Gig Yard (ABN 26 926 532 315), a business registered in Tasmania, Australia, operated by Abhishek Somnath Menon.
2. Use of Platform
GigYard is an online marketplace connecting venues with live music performers. We facilitate bookings, payments, and communications between parties, we are not party to the performance agreement itself.
You must be at least 18 years old to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account details up to date. You are responsible for all activity that occurs under your account.
You must not use GigYard to engage in unlawful activity, harass other users, post false or misleading content, or interfere with the platform's operation.
3. Band Obligations
Bands who list on GigYard agree to:
- Provide accurate, up-to-date profile information including demos, pricing, and availability - Respond to booking requests within 24 hours - Fulfil all confirmed bookings. Failure to perform without valid cause may result in account suspension and forfeiture of deposit protection rights - Complete Stripe identity verification as required by our payment provider - Maintain a valid Australian bank account for payouts - Comply with all applicable laws, including any licensing requirements for public performance
Bands must not solicit venues to book outside the GigYard platform during the exclusivity period described in Section 7.
4. Venue Obligations
Venues who book through GigYard agree to:
- Provide accurate event information including date, location, and event type - Pay the 25% deposit within the timeframe specified after a band accepts a booking request - Pay the 75% balance no later than 7 days before the event - Ensure the performance space is safe, accessible, and meets any technical requirements communicated by the band - Not solicit bands to perform outside the GigYard platform during the exclusivity period described in Section 7
Venues who fail to pay by the deadline or cancel without cause may forfeit their deposit and face account restrictions.
5. Payment Terms
All payments are processed securely via Stripe. GigYard charges:
- Venues: a 10% service fee on top of the band's quoted price - Bands: an 8% commission deducted from the payout after a completed event
Payment schedule: - A 25% deposit is due when the venue confirms the booking after band acceptance - The remaining 75% balance is due 7 days before the event date - Band payouts are released 24 hours after the event is completed
All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable. GigYard is not responsible for Stripe's processing fees or currency conversion charges.
6. Cancellation Policy
GigYard's full cancellation terms are set out in the GigYard Service Agreement signed by both parties at the time of booking. In summary:
- If a band cancels: the venue receives a full refund of all payments, including the deposit - If a venue cancels after the deposit has been paid: the band retains the deposit as compensation - If a venue cancels after the full balance has been paid: additional cancellation fees apply on a sliding scale based on proximity to the event date
GigYard will make reasonable efforts to assist affected parties in finding alternatives where possible. Cancellations due to genuine emergencies or force majeure events will be assessed on a case-by-case basis.
7. Platform Exclusivity
To maintain the integrity of the GigYard marketplace, bands and venues who are connected through our platform agree to a 24-month exclusivity window for that specific band-venue relationship. During this period, direct bookings outside GigYard for events at the same venue are prohibited.
This clause exists to protect both parties: bands are guaranteed fair payment protection, and venues benefit from GigYard's dispute resolution and verification systems.
Breach of this exclusivity clause may result in account suspension, recovery of platform fees, and legal action where appropriate.
8. Intellectual Property
All content on GigYard, including the GigYard name, logo, design system, and platform code, is the property of Gig Yard and is protected by Australian and international copyright laws.
Users retain ownership of content they upload (photos, videos, profile text). By uploading content, you grant GigYard a non-exclusive, royalty-free, worldwide licence to display and use that content for the purpose of operating and marketing the platform.
You must not upload content that infringes on the intellectual property rights of others.
9. Limitation of Liability
To the maximum extent permitted by Australian law, Gig Yard is not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of revenue, data, or goodwill.
GigYard facilitates connections and payments between parties but does not guarantee the quality of performances or the conduct of any user. Our total liability to you for any claim shall not exceed the total fees paid by you to GigYard in the 12 months preceding the claim.
Nothing in these terms limits liability that cannot lawfully be excluded under the Australian Consumer Law.
10. Governing Law
These Terms of Service are governed by the laws of Tasmania, Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Tasmania and the Federal Court of Australia.
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force.
GigYard reserves the right to update these terms at any time. Continued use of the platform after changes constitutes acceptance of the updated terms. We will notify users of significant changes via email.
